Jan 25th 2012 - Is 43.3p the current FIT rate ?
Following the second Court defeat the Government have put in another appeal to the Supreme Court. The feeling within the Solar Industry is that the government has done this to attempt to maintain uncertainty and confusion in the market until 3rd March, hoping to keep the level of installations low.
The reality is this, at this moment in law, the government have lost two high court appeals and that means that installations between 12th December and 3rd March will be at 43.3p for installations up to 4kwp, UNLESS government get and win a Supreme Court appeal. A very unlikely, but a possible outcome.
What this means for the Consumer is :-
If you install before 3rd March you will as a very minimum get a 21p FIT rate. If the Government fail to win at the Supreme Court you WILL get 43.3p.
Instead of certainty this leaves you with a choice to hedge their bets. Install now and definitely get 21p, and very, very likely get 43.3p. But we cannot guarantee that.
The Government tried to slash the FIT rate down to 21p in December 2011, the Solar Industry challenged this cut in Court, and the Cut was declared illegal, however the Government appealled to the High Court and on Jan 25th lost this appeal as well. As well as this the Gov'e put through legislation to reduce the tariffs to 21p on 3rd March whatever the Court outcome is.
